Anyone operating transient lodging in unincorporated Sutter County must register with the county within 30 days of commencing business, post a Hotel/Motel Registration Certificate on the premises, and keep surcharge records for three years.
Sutter County Code Sec. 150-060 requires each operator of a hotel/motel, a definition broad enough to include short-term rentals (Sec. 150-010), to register the property with the county within 30 days after commencing business and obtain a Hotel/Motel Registration Certificate. The certificate must be posted at all times in a conspicuous place on the premises and must state the operator's name, the property address, the issuance date, and prescribed text confirming the operator is registered to collect and remit the surcharge. Operators must keep and preserve for three years all records necessary to determine the surcharge amount (Sec. 150-100), and must file quarterly returns with remittance by the last day of the month following each calendar quarter (Sec. 150-070). Returns and payments are due immediately if the business ceases for any reason.
Operating without registering, failing to post the certificate, or failing to keep records willfully violates Chapter 150, punishable as a misdemeanor or infraction under Sec. 150-130, in addition to surcharge penalties and interest under Sec. 150-080.
