Modoc County does not have a garage-sale-specific sign ordinance; such signs fall under the temporary-sign provision of the County's general sign regulations. Zoning Code Section 18.110.070(A)(5) provides for temporary signs: 'One sign per lot provided each sign area does not exceed thirty-two square feet, except in the RH, RL, or RR zone the total temporary sign area shall not exceed four square feet.' A garage or yard sale notice qualifies as a temporary sign and is allowed within those limits without a County sign permit. The general sign rules still apply: no sign may be placed in or over a public right-of-way unless an encroachment permit is obtained (Subsection K); attached signs and floodlights in a public right-of-way must have at least twelve feet of clearance and comply with Chapter 12.04 of the County code; no blinking, flashing or animated signs are allowed (Subsection F); and illuminated signs may not interfere with traffic-control devices (Subsection G). Signs that exceed the size or number criteria may be allowed only with a use permit (Subsection C). Because rural residential zones (RH, RL, RR) cap total temporary sign area at four square feet, garage sale signs in those neighborhoods must be small, while in agricultural and other zones the limit is the more generous 32 square feet per sign. All signs must be maintained in a safe and readable condition (Subsection L).
Displaying a garage sale sign larger than the applicable limit (32 sq ft generally, or a 4-square-foot total in the RH, RL and RR zones), posting more than one per lot, or placing a sign in or over the public right-of-way without an encroachment permit violates Section 18.110.070 and can result in removal and zoning enforcement.
