Sumner County protects yard political signs. Its zoning resolution defers election signage to the Tennessee Freedom of Speech Act, Tenn. Code Ann. §2-7-143, which bars local limits on the shape or number of campaign signs on private property near an election.
The Sumner County Zoning Resolution (Chapter 12) states that election signage "shall be regulated by the Tennessee Freedom of Speech Act of 2017," and where the two conflict, the statute wins. Under §2-7-143 the county and its cities cannot regulate the shape or quantity of campaign signs an owner or resident places on private property more than 100 feet from a polling place, from 60 days before voting through the day after the election. Residential signs up to 16 square feet are protected. Signs in the public right-of-way get no protection and may be removed. Candidates must clear right-of-way signs within three weeks after the election.
Signs planted in the public right-of-way violate the sign rules and are removed and disposed of by the county. Right-of-way campaign signs left past three weeks after an election become the candidate's responsibility.
