The county's 2025 Zoning Code Audit states it is the county's policy to regulate signs in a constitutional manner that is content-neutral as to noncommercial signs and viewpoint-neutral as to commercial signs, and that the current sign regulations are consistent with State law and require no additional action. Because of the U.S. Supreme Court decision in Reed v. Town of Gilbert (2015), local governments cannot single out political or campaign signs for special restrictions based on their message; political signs are treated as protected noncommercial speech. Separately, California Business and Professions Code Section 5405.3, part of the state Outdoor Advertising Act, governs temporary political signs visible from state highways: such a sign may be placed no sooner than 90 days before an election, must be removed within 10 days after the election, may be no larger than 32 square feet, and must not be placed in a highway right-of-way or within 660 feet of a landscaped freeway. A statement of responsibility for removal must be filed with Caltrans. These statewide limits matter in Siskiyou County given the Interstate 5 corridor running through it. For sign placement off the state highway system, owners should confirm the applicable Article 58 standards with the Planning Division.
Signs that exceed county Article 58 standards or are placed without a required permit may be subject to a county correction notice and removal. Political signs in the state-highway right-of-way, or that exceed the Business and Professions Code 5405.3 limits, can be removed by Caltrans, with removal costs charged to the responsible party named in the filed statement of responsibility.
