Siskiyou County totally bans personal fireworks in unincorporated areas. Unlike many California jurisdictions that allow state-approved 'safe and sane' fireworks, Siskiyou County enforces a complete ban. Adopted by the Board of Supervisors as Ordinance No. 22-11 and codified at County Code Section 3-3.1.04, the rule states that no person shall sell, offer for sale, use, discharge, display, possess, or store fireworks (as defined in Health & Safety Code Section 12511) within the unincorporated area of the county. The ban reflects the county's severe wildfire exposure across its heavily forested mountain terrain, including the Mt. Shasta and Marble Mountains regions, and a history of destructive fires. Limited exceptions exist for public fireworks displays authorized in writing by the California State Fire Marshal and conducted under that authorization, for emergency signaling devices used in genuine emergencies, and for narrow categories such as agricultural and wildlife fireworks, model rocket motors, and exempt fireworks listed under the Health & Safety Code when approved in writing by the responsible fire jurisdiction. Because the prohibition covers possession and storage, simply having consumer fireworks in the unincorporated county is unlawful. Incorporated cities such as Yreka, Mount Shasta, and Weed set their own rules, so residents should confirm whether an address is inside city limits or in the unincorporated county.
Violating the fireworks ban can lead to citation under County Code and seizure of the fireworks; fireworks offenses are also enforceable under California Health & Safety Code Section 12500 et seq. Anyone causing a wildfire may face cost-recovery for suppression and additional state penalties.
