The county's zoning ordinance regulates signs by size and type, not message, so after Reed v. Town of Gilbert a campaign sign is treated like any temporary sign. A non-illuminated sign up to 2 square feet is exempt, needs no permit, and is limited to two per street frontage (§154.373(G)). A larger temporary sign in a residential district may reach 24 square feet per frontage and 6 feet tall, two signs maximum (§154.379). Signs may not stand in the public right-of-way. South Bend and Mishawaka set their own sign codes inside their limits. The county cannot ban a sign or shorten its display because of its political content.
Signs over the size or number limits, or placed in the public right-of-way, are prohibited and may be removed by the county. Sign-code violations carry civil zoning penalties.
