Stores may not provide thin single-use plastic carryout bags. Customers may bring reusable bags or purchase a compliant reusable bag (made of cloth, woven plastic, or 40%+ recycled-content recyclable paper) for at least 10 cents. The 10-cent fee is retained by the retailer and cannot be waived. SB 1053 (effective 2026) tightens reusable-bag definitions further.
Retailer non-compliance triggers civil penalties up to $1,000 for the first violation and $5,000 for subsequent violations under Cal. Public Resources Code Β§42288, enforceable by city attorneys or the Attorney General.
