However, California's Plastic Pollution Prevention and Packaging Producer Responsibility Act (Senate Bill 54, Public Resources Code Β§Β§42040-42081) requires 100% of single-use plastic packaging and foodware sold in California to be recyclable or compostable by 2032, with phased reductions starting in 2027. SB 54 will indirectly eliminate most polystyrene foodware statewide.
No local Fresno violation exists for polystyrene foodware. State SB 54 violations begin in 2027 and target packaging producers, not individual restaurants, with fines up to $50,000 per day for non-compliant producers.
