Oregon Senate Bill 543, effective January 1, 2025, bars food service establishments from selling or distributing prepared food in expanded polystyrene foam containers, cups, plates, bowls, trays, or clamshells. The law also prohibits the sale of polystyrene loose-fill packing peanuts and food containers containing intentionally added perfluoroalkyl and polyfluoroalkyl substances (PFAS). Codified provisions appear in ORS Chapter 459A. The Oregon Department of Environmental Quality administers compliance, with penalties for repeat violations. Limited exemptions exist for raw uncooked meat trays and food packaged outside Oregon.
Civil penalties may reach $100 to $500 per violation, with higher amounts for repeat offenses.
