Texas Health and Safety Code Β§361.0961, as interpreted by the Texas Supreme Court in Laredo Merchants 2018, preempts local rules regulating disposable containers including expanded polystyrene foam. As a result, El Paso cannot prohibit foam clamshells or cups in private restaurants. The city may still set internal procurement policies for City Hall cafeterias, public events on city property, and contractor agreements aligned with the 2020 Climate Action Plan and Plan El Paso. Border-area waste, including foam blowing into the Rio Grande and Ciudad Juarez, remains a regional concern that environmental groups raise without enforceable local authority.
There are no enforceable private-business violations because state preemption blocks bans. City vendors and event organizers on city property may face contract penalties for breaching internal sustainability rules.
