Several OC coastal cities adopted local EPS bans much earlier to protect beaches and marine life: Laguna Beach (2008), Dana Point, Huntington Beach, Seal Beach, San Clemente, and Aliso Viejo all prohibit EPS foam takeout. Restaurants must use paper, plant-fiber, recyclable plastic, or aluminum alternatives. OC unincorporated coastal areas like Sunset Beach follow the relevant city ban or county sustainability policy.
Local fines typically $100 first offense, $200 second, $500 each subsequent. State enforcement under SB 54 begins 2025 with civil penalties up to $50,000 per day for producers.
