Tulsa cannot prohibit polystyrene foam cups, takeout clamshells, or coolers. Oklahoma's 2019 auxiliary-container preemption (OK Β§11-22-101) bars cities from banning or taxing foam packaging. Restaurants may switch voluntarily for cost or branding reasons but face no city mandate.
Oklahoma's auxiliary-container preemption statute (SB 1001, 2019) specifically lists polystyrene foam among items that municipalities may not ban or charge fees for. Tulsa restaurants, food trucks, and grocers may freely use foam clamshells, cups, and meat trays. Some Tulsa operators voluntarily switch to recyclable or compostable alternatives, but no city ordinance rewards or requires that switch. Foam waste enters the residual trash stream because most curbside recycling does not accept it. Improperly dumped foam in waterways or rights-of-way is enforceable under Title 24 nuisance and OK littering rules even though the underlying material is legal.
There are no Tulsa fines for using polystyrene. Littering foam containers onto streets, parks, or rivers remains punishable under Tulsa Title 24 nuisance enforcement and Oklahoma littering statutes (OK Β§21-1753).
