MCL 445.594c blocks any Wayne County municipality from banning expanded polystyrene foam containers used for food and beverages. The 2016 statute was designed to ensure uniform packaging rules across Michigan and applies to all auxiliary containers, including foam clamshells and cups. Even after several states moved to ban polystyrene, Michigan localities cannot follow suit without state legislative action. Restaurants, schools, and government cafeterias may voluntarily switch to alternatives, and Detroit and Wayne County procurement contracts can specify non-foam packaging for their own operations. Recycling of polystyrene remains limited because most Wayne County curbside programs do not accept it.
Any local foam ban would be unenforceable. Procurement-based standards are limited to government's own purchasing and cannot be imposed on private vendors.
