Fairfax County has not adopted a plastic straw ordinance. Virginia has not preempted nor authorized county straw rules, so local restaurants may freely provide plastic straws to customers.
Unlike California, Washington DC, and Seattle, Virginia has not enacted statewide plastic straw legislation, and the General Assembly has not delegated authority for counties or cities to adopt straws-on-request rules. Under Virginia Dillon's Rule, Fairfax County cannot impose a binding straw ordinance without an explicit grant. Restaurants, coffee shops, and food trucks in Tysons, Reston, Mosaic District, and elsewhere in Fairfax may freely supply plastic straws. The Fairfax County Office of Environmental and Energy Coordination encourages voluntary reduction, and several businesses have switched to paper or PLA-based alternatives. Customers concerned about plastic use can simply request no straw or bring a reusable.
There are no county penalties because no straw ordinance exists. Violations of voluntary corporate policies are handled by the business itself, not Fairfax County government.
