Drone privacy in Virginia balances federal airspace authority against state and common-law privacy protections. Under VA Code Section 18.2-324.2 (Peeping with technology), intentionally and maliciously using a drone, camera, or similar device to observe, film, or photograph another person in a dwelling or enclosed area where privacy is reasonably expected is a Class 1 misdemeanor, escalating to Class 6 felony for repeat offenses or when victims are minors. VA Code Section 18.2-60.5 addresses unlawful use of unmanned aircraft systems (drones) to trespass on property. Civil claims available to victims include intrusion upon seclusion (common-law tort), nuisance, and stalking (VA Code Section 18.2-60.3). The Fourth Amendment protects against government drone surveillance without warrant in most residential contexts (see Florida v Riley, 488 US 445, 1989 for aerial observation doctrine; drone-specific jurisprudence evolving). Civilian drone operators should avoid filming into neighbor windows, over fenced backyards, or near private pools and decks where occupants reasonably expect privacy. Publishing drone footage of identifiable persons without consent may also expose operators to claims under Virginia's right of publicity statute (VA Code Section 8.01-40) for commercial uses. Law enforcement drone deployment in Virginia requires warrants for most investigative uses under VA Code Section 19.2-60.1.
