ARCs must apply standards set forth in the declaration and published design guidelines; they cannot impose arbitrary or capricious requirements. Virginia Code 55.1-1819 provides that ARCs must act on applications within a reasonable time (commonly 30 to 60 days) and must provide written reasons for denials. Owners may appeal ARC decisions to the HOA board. Virginia law provides specific statutory protections for certain improvements: solar energy systems (VA Code 67-701), political signs (VA Code 55.1-1820.1), American and military flags, and religious displays on doorways. HOAs may not unreasonably prohibit these protected uses but may impose reasonable aesthetic conditions. Unauthorized modifications may require removal at owner's expense, plus fines, legal fees, and restoration of the property to pre-violation condition under POAA enforcement authority.
