T.C.A. 66-9-205, enacted in 2011 and amended through 2023, makes void and unenforceable any covenant or HOA rule that prohibits or has the effect of prohibiting residential solar energy collectors. HOAs may still impose reasonable restrictions on placement, screening, and aesthetics that do not significantly increase cost or decrease performance. The statute applies statewide and overrides conflicting private covenants. It does not apply to historic districts.
Unenforceable HOA solar bans; homeowners may seek declaratory relief and attorney fees in some cases.
