Unlike Florida, Arkansas has no statute stopping an HOA from restricting solar panels. The 2019 Solar Access Act (Act 464) addressed net metering and leasing, not HOA covenants, so your CC&Rs control.
This is where Arkansas differs from many states. No Arkansas solar-rights law overrides homeowners-association covenants. The 2019 Solar Access Act (Act 464, formerly SB 145) expanded net metering and opened the door to third-party solar leasing, but it did not limit an HOA's power over rooftop solar. So if your recorded CC&Rs restrict or prohibit solar collectors, or require architectural-committee approval, those provisions are generally enforceable in Washington County. Read your covenants and submit plans to the architectural review committee before signing an install contract. Many Northwest Arkansas HOAs do allow roof solar with reasonable placement and screening conditions, but they are not required to.
Installing panels against enforceable HOA covenants can bring association fines, a demand to remove the array, and liens for unpaid penalties. Disputes are resolved through the HOA process or civil court.
