Unlike roughly 30 states with solar access laws, Nebraska has no statute limiting HOA authority over solar panel installations (as of 2025). Legislation similar to LB 149 (2021) has been introduced but not enacted. As a result, Douglas County HOAs operating under their recorded Declarations of Covenants, Conditions and Restrictions (CC&Rs) and the Nebraska Condominium Act (NRS §§76-825 to 76-894) or the Nebraska Real Estate Subdivision Act may legally prohibit solar panels outright, require architectural review committee (ARC) approval, restrict placement to non-street-facing roof planes, regulate panel color and racking, or condition approval on screening. Homeowners should submit plans to the ARC before installation. ARC decisions that are arbitrary, capricious, or in bad faith may be challenged under Nebraska contract and fiduciary-duty case law. Non-HOA properties in Omaha and unincorporated Douglas County are not subject to these restrictions.
