PA Act 88 of 2022 (Solar and Electric Vehicle Charging Station Rights Act) prohibits HOAs in Allegheny County from unreasonably restricting residential solar installations. Aesthetic-only bans are void.
Under PA Act 88 of 2022, planned communities and condominium associations cannot prohibit or unreasonably restrict owner installation of solar energy systems. An HOA restriction is reasonable only if it does not significantly increase cost (over 10%) or significantly decrease efficiency (over 10%). HOAs may impose reasonable aesthetic standards (color-matched rails, flush mounting) but cannot impose outright bans. This protects homeowners in Cranberry-adjacent, McCandless, Upper St Clair, and other planned communities. Act 88 aligns PA with California and Florida solar access laws.
HOA violators face declaratory judgment, attorney fees awarded to prevailing owner under Act 88. Unreasonable denial is grounds for injunction.
