Texas Property Code 202.010 prohibits HOAs from banning solar panels on Frisco homes. HOAs may regulate placement for aesthetics only if alternative does not cost 10 percent more or reduce output more than 10 percent. Written HOA denial must cite the statute.
TX Prop. Code 202.010 (enacted 2011) is a strong pro-solar statute. HOAs in Frisco including Stonebriar, Starwood, Phillips Creek Ranch, and Newman Village cannot prohibit rooftop solar. They may require panels on a roof slope not facing the street IF such alternate location meets the 10/10 efficiency test. HOA approval process must complete within 60 days or deemed approved. Violation by HOA exposes them to attorney fees and damages under 202.004.
