Under Florida Statute 163.04, no HOA or covenant in Indiantown may prohibit solar collectors on a residence. HOAs may regulate placement only to the extent that doing so does not impair effective operation of the system.
Fla. Stat. 163.04 is a strong solar-rights statute that prohibits any 'deed restriction, covenant, declaration or similar binding agreement' from prohibiting solar collectors, clotheslines, or other energy-saving devices on residential property. HOAs may impose reasonable aesthetic restrictions (orientation, color of conduit, location on the south- or south-east-facing roof slope), but only where doing so does not reduce system output by more than a de minimis amount. A 2022 case (Sherry Vassallo Bahr v. The Reserve at Spanish Trace) reaffirmed the broad scope of Fla. Stat. 163.04. HOA aesthetic guidelines that effectively prohibit solar are unenforceable.
An HOA that enforces an unlawful prohibition can be sued for declaratory and injunctive relief and may be liable for the homeowner's attorney's fees and costs under Fla. Stat. 720.305.
