Ohio gives HOA solar only limited protection. Senate Bill 61 lets a Licking County owner install panels unless the declaration specifically prohibits them, and associations may still set reasonable size and placement rules.
Ohio's Senate Bill 61 (2022) added solar protections to the planned-community law, but they are weaker than Florida's. Under Ohio Revised Code Section 5312.16, an owner may install a solar energy collection device unless the association's declaration specifically prohibits it, and the association can still adopt reasonable restrictions on the size, place, and manner of placement. So a Licking County HOA cannot casually deny solar, but a declaration that expressly bans panels is enforceable, and changing it typically needs a supermajority owner vote. Condominium owners get parallel protection under Section 5311.192. Ground-mounted arrays may face closer review than roof panels.
An association that blocks a compliant system where the declaration does not prohibit it, or buries a ban in unreasonable conditions, is exceeding what Ohio law allows and risks a court challenge.
