Texas Property Code Section 202.010 limits Lubbock HOAs from banning solar energy devices. HOAs may only impose restrictions that do not substantially reduce the devices effectiveness or increase cost by more than 10 percent.
Texas Property Code 202.010 preempts HOA blanket solar bans statewide. In Lubbock, that means HOAs cannot refuse a solar panel installation on a roof or fenced yard. HOAs may still regulate placement on street-facing roof planes if an alternate location with similar solar performance exists, and they may require the panels to conform to the roof slope and color (frames and mounting hardware of silver, black, or bronze). HOAs may require advance notice and approval of plans but cannot unreasonably delay approval. Wind energy devices are covered by a similar rule in Section 202.019. HOAs violating the statute risk attorney-fee exposure if a homeowner sues.
