Unlike California, Florida, and 20+ other states, Georgia has NOT enacted a solar access or solar rights law that overrides HOA restrictions on rooftop solar. HOAs in Cobb County communities β including major developments in East Cobb (Indian Hills Country Club, Lassiter Crossing), West Cobb (Harbins Pointe, Brookstone), Vinings (Paces Mill), and Kennesaw (Legacy Park) β may through their CC&Rs and architectural review committees restrict or effectively prohibit rooftop solar panel installations on aesthetic grounds. Homeowners must submit to ARC review before installation and may be required to conceal panels from street view, use low-profile mounting, or accept denial. Some HOAs explicitly allow solar with aesthetic conditions. Prospective solar installers should review CC&Rs carefully before purchase or installation. Georgia House Bill attempts to create solar access protections have not passed as of 2026.
