Michigan's Homeowners' Energy Policy Act, 2024 PA 68, took effect April 2, 2025. It makes any HOA provision that prohibits or effectively prohibits rooftop solar invalid, so Saginaw County associations cannot ban panels.
Michigan now protects rooftop solar from homeowners' associations. The Homeowners' Energy Policy Act, 2024 PA 68 (MCL §559.301 et seq.), effective April 2, 2025, makes any HOA agreement or policy that prohibits, or has the effect of prohibiting, the installation of a solar energy system invalid and unenforceable. Each association had to adopt a written solar energy policy statement by the deadline, and that policy cannot cut a system's electricity output by more than 10% or add more than $1,000 to the installation cost. Associations may still set reasonable placement and aesthetic rules, but not ones that effectively block a homeowner. A Saginaw County homeowner outside any HOA faces only local building and electrical permits.
An HOA that enforces a covenant or policy banning rooftop solar acts unlawfully; the homeowner may keep the system and challenge the rule. Fines for violating valid placement rules vary by the association's governing documents.
