Mahwah's zoning code defines and regulates solar energy systems and solar collection facilities, distinguishing on-site accessory uses from off-site generation.
Chapter 24 (Zoning) of Mahwah's code establishes definitions and standards for solar installations. A 'solar energy system' is one or more photovoltaic, concentrated solar thermal, or solar hot water devices, free-standing, building-integrated, or roof-mounted, intended to reduce or meet the energy needs of the property's principal use. A 'solar collection system' is a larger area of land or canopy used principally to capture solar energy and supply electrical or thermal power primarily for off-site use. The two categories are treated differently in zoning approvals, with on-site accessory systems generally permitted while off-site collection systems face additional siting standards. Building permits and electrical permits remain required through the Township construction office.
Installing a solar collection system without proper zoning approval may trigger stop-work orders and removal demands. Operating without required building or electrical permits can result in fines and require corrective inspection.
