Houston Code of Ordinances Chapter 38 (Peddlers, Solicitors, and Itinerant Merchants) requires any person engaged in door-to-door commercial sales or solicitation to first obtain a peddler/solicitor license issued by the Administration & Regulatory Affairs (ARA) Department. The application process includes fingerprinting, a criminal background check, proof of identity, employer information, and a description of the goods or services to be offered. ARA issues a photo identification badge that the licensee must visibly display while operating in the city. Licenses are typically valid for one year and renewable.
Religious, political, and charitable canvassing is exempt under the First Amendment and Watchtower Bible v. Stratton (2002). Solicitation hours are restricted to 9:00 AM through sunset, and licensees must immediately leave any residence that displays a "No Soliciting" or "No Trespassing" sign. The ARA director may deny, suspend, or revoke a license for false statements, fraud, or repeated violations.
Operating without a license, soliciting outside permitted hours, failing to display the badge, or ignoring a "No Soliciting" sign is a Class C misdemeanor under Houston Code, punishable by fines up to $500 per offense. Each day constitutes a separate offense. License revocation and trespass charges are also possible.
