Phoenix City Code Chapter 31 (Solicitors and Peddlers) requires any person engaged in door-to-door commercial canvassing or peddling to first obtain a city solicitor permit. The applicant must apply through the Phoenix City Clerk's Office, submit fingerprints, undergo a Phoenix Police Department background check, and provide identification, employer information, and a description of the goods or services offered. Upon approval the city issues a photo ID card that the permittee must visibly display while operating in Phoenix. Permits are typically valid for one year and are renewable.
Consistent with Watchtower v. Stratton (2002), the chapter exempts religious, political, and charitable canvassing from the permit requirement because such expressive activity is constitutionally protected. Commercial solicitation hours are restricted to between 9:00 AM and sunset, and commercial canvassers must respect any posted "No Soliciting" sign and leave the premises immediately. The City Clerk may deny or revoke a permit for fraud, disqualifying criminal history, or violations of the chapter.
Soliciting without a permit, soliciting outside permitted hours, failing to display the city ID, or ignoring a "No Soliciting" sign is a Class 1 misdemeanor under Phoenix City Code Β§1-5, punishable by fines up to $2,500 and/or up to six months in jail per offense.
