Idaho Right to Farm Act and Open Range Law

Idaho Code Section 22-4503 prevents agricultural operations that have been in lawful operation for at least one year from becoming a nuisance due to changed conditions in surrounding nonagricultural uses. Idaho Code Section 25-2118 confirms that no person owning livestock that lawfully roam open range has a duty to keep them off another person's unfenced land. Local herd districts may be formed under Idaho Code Title 25, Chapter 24, but municipalities cannot override the statewide Right to Farm protections or change open range status by ordinance. Cities retain zoning authority over urban backyard chickens and livestock numbers.

Improper nuisance suits against protected agricultural operations may be dismissed with attorney fees awarded under Section 22-4504. Damaging trespassing livestock requires herd district status.
