New York State Dog Nuisance and Owner Liability

Article 7 of the New York Agriculture and Markets Law governs licensing, identification, and control of dogs statewide. Section 123 authorizes any person to file a dangerous-dog complaint with a local court, and Section 124 permits municipalities to enact further regulations on barking, running at large, and habitual nuisance behavior. Section 121 imposes universal owner liability for medical costs and damages caused by dangerous dogs. While localities may adopt their own barking-dog ordinances under Section 124, the state framework for owner identification, licensing, and judicial dangerous-dog proceedings applies in every city, town, and village across New York.

Civil penalties up to $400 for unlicensed dogs, dangerous-dog adjudications with mandatory restraints, owner liability for veterinary and medical costs, and possible humane destruction orders for dogs causing serious injury.
