Under 53 P.S. 3704 and similar enabling provisions in the Borough Code and Township Codes, municipalities may enact curfews for minors under 18. State enabling law universally requires reasonable exemptions for emergencies, employment, and First Amendment activity. Curfew detentions must follow Juvenile Act procedures (42 Pa.C.S. 6301 et seq.). Local curfews not meeting state due process standards are unenforceable.

Curfew violations are typically summary offenses; fines up to $300 plus parental liability in some jurisdictions. Improperly drafted curfews may be struck down on constitutional grounds.
