Allentown, PA Curfew Laws: Juvenile Curfew (2026)

Chapter 232, adopted in 1997 by Ordinance No. 13583, is a daytime curfew, not a nighttime one: § 232-3.A makes it unlawful for any minor of compulsory school age enrolled in a school to be in a public place or on the premises of any establishment within the City between 9:00 a.m. and 2:30 p.m. on any day school is in session, unless the minor is on a scheduled vacation, has permission to be absent, or is home-schooled under Pennsylvania School Code § 1327.1. Section 232-3.B places the same duty on custodians, making it unlawful for a custodian to knowingly permit a minor to violate the curfew, and § 232-3.C extends liability to any adult who acts as an accomplice.

A first offense results in the minor being taken into custody, identified, and returned to school subject to discipline, including possible in-school suspension. A second or later offense in the same school year exposes the minor, on summary conviction, to a fine of up to $600 per offense plus costs, with unpaid fines referred to Juvenile Court under 42 Pa.C.S.A. § 6301 et seq.; a Magisterial District Judge may substitute community service. Custodians who fail to comply face the identical $600 fine, and, if the fine and costs go unpaid, up to 90 days' imprisonment, with community service available at the judge's discretion in place of a fine.
