Utah Medical Cannabis Pharmacy Licensing and Zoning

Under Utah Code 26B-4-218 and related provisions in the Medical Cannabis Act, the Department of Health and Human Services licenses a limited statutory number of Medical Cannabis Pharmacies geographically distributed across the state. State law sets minimum buffers and operating standards (security, inventory tracking, age limits, hours). Municipalities and counties may not enact ordinances that conflict with the state license framework or create a de facto prohibition that defeats the statutory geographic distribution. Local governments retain authority to impose neutral zoning rules (commercial zones, parking, signage), reasonable additional buffers, and conditional-use review consistent with state law.

Operating a cannabis pharmacy without a state license is a felony; local ordinances that conflict with state licensing limits or distribution mandates may be preempted and unenforceable.
