In unincorporated Mendocino County, prefabricated above-ground pools that sit entirely above adjacent grade and hold no more than 5,000 gallons are exempt from a building permit. Larger above-ground pools, or those needing electrical hookups, still require permits, and all outdoor pools must have a compliant safety barrier under the adopted California Residential Code.
Mendocino County's Title 18 (Building Regulations), through its adoption of the California Residential Code, exempts certain small above-ground pools from the building permit requirement. Prefabricated swimming pools accessory to a single-family (Group R, Division 3) residence, in which the pool walls are entirely above the adjacent grade and the capacity does not exceed 5,000 gallons, do not require a building permit. Above-ground pools that exceed 5,000 gallons, are partially set into the ground, or require new electrical circuits for pumps and heaters fall outside this exemption and need permits from the Planning and Building Services Department. Importantly, the permit exemption does not waive the safety-barrier requirement: any outdoor pool, spa, or hot tub must still be enclosed by a barrier meeting the adopted California Residential Code (Section 710A) standards, including the 60-inch minimum height and self-latching gate, and that barrier must be inspected before the pool is filled. For an above-ground pool, the pool wall itself may serve as part of the barrier if it meets the height and climbability standards, but any attached ladder or steps must be removable or otherwise secured against child access.
Installing an above-ground pool that exceeds the 5,000-gallon exemption without a permit, or leaving a non-removable ladder on an above-ground pool that lacks a compliant barrier, can trigger code-enforcement action and require corrective work before the pool is approved for use.
