An above-ground pool needs a municipal UCC permit if it holds water more than 24 inches deep. Prefabricated pools under 24 inches deep, under 5,000 gallons, and entirely aboveground are exempt. Barrier rules still apply to permitted pools.
The statewide Uniform Construction Code, not Montgomery County, governs above-ground pools. Under 34 Pa. Code 403.42(c)(1)(viii), a prefabricated pool accessory to a Group R-3 home is exempt from a permit only when it is less than 24 inches deep, does not exceed 5,000 gallons, and is installed entirely aboveground. A deeper or larger above-ground pool requires a building permit from your borough or township, plus a barrier permit and any electrical permit. Even where the pool wall itself serves as part of the barrier, ladders and steps must be removable, lockable, or otherwise secured per the adopted code.
Installing a non-exempt above-ground pool without a municipal permit is a UCC violation subject to stop-work orders and daily code-enforcement fines set by the borough or township; the county imposes none.
