New Jersey's UCC (N.J.A.C. 5:23) and the 2018 Swimming Pool and Spa Code treat an above-ground pool as a structure: capable of holding more than 24 inches of water usually triggers a construction permit filed with your municipal construction official. The barrier rule still applies β where the pool wall itself is at least 48 inches high it can serve as the barrier, but a fixed ladder or steps must be removable, lockable or gated so children cannot climb in. Camden County does not permit or inspect residential above-ground pools; the county health department only handles public bathing facilities under N.J.A.C. 8:26.
