Above-ground pools in Delray Beach require a building permit and must meet FL 515 barrier requirements. Pools with walls 48 inches high can serve as their own barrier if the ladder is removable or lockable.
Delray Beach treats above-ground pools the same as in-ground for permitting: a building permit, electrical permit for pump bonding, and final inspection are required. LDR Sec. 4.6.15 setbacks apply (10 feet rear, 7.5 feet side). If the pool wall itself is 48 inches high, it can serve as the barrier provided the ladder is removable, locked, or surrounded by its own barrier when not in use. Inflatable and portable pools over 24 inches deep also require permits per FBC. Decks attached to above-ground pools require separate permits.
Unpermitted above-ground pool: 250 dollars/day plus double permit fee. Unbarriered ladder access: 500 dollars under FL 515 enforcement.
