The County's Work Exempt from Permits list states that 'prefabricated swimming pools that are less than 24 inches deep' do not require a building permit, consistent with California Residential Code exemptions adopted in Nevada County Code Title 14. An above-ground pool deeper than 24 inches is not exempt and requires a building permit through the Community Development Agency Building Department. Whether or not a building permit is required, the drowning-prevention barrier rules still apply to a pool capable of holding water deep enough to be a hazard: the County's Swimming Pool Safety Barrier Requirements form (citing State Health and Safety Code Sections 115920 to 115927) requires a 60-inch barrier with self-latching gates and limited openings, and for an above-ground pool the wall structure plus barrier must prevent uncontrolled child access. Setback rules from the County Building Setbacks brochure also apply: a minimum of 10 feet from any side or rear property line, and no placement within a required front yard setback. Owners installing a larger above-ground pool should confirm both permit and barrier requirements with the Building Department before filling the pool.
