Above-ground pools deeper than 24 inches need a municipal UCC permit and a compliant barrier. The pool wall can serve as the barrier if it is at least 48 inches high and the ladder or steps can be secured, locked, or removed when the pool is unattended.
There is no county rule; the PA UCC's ISPSC applies through your municipality (Allentown, Whitehall, Emmaus, etc.). An above-ground pool over 24 inches deep requires a building permit. Under ISPSC Section 305.5, where the pool structure itself is the barrier, the wall must meet the 48-inch height rule and the access ladder or steps must be capable of being secured, locked, or removed to prevent access. In Allentown zoning, an above-ground pool is an accessory use and may even sit on an abutting commonly owned lot under Section 660-41.B(1).
An unpermitted or unsecured above-ground pool can draw a stop-work order and municipal fines; leaving a ladder up on an unbarriered pool is a code violation.
