The county rule makes no exception for above-ground pools: "We require a Miscellaneous Permit for swimming pools of any size (both in-ground and above ground) and related structures (diving boards, ladders, etc.)." All swimming pools, related structures, hot tubs, and swim spas "need to meet required setbacks and height limitations," which are "determined by your property's zone district." Prefabricated swimming pools are one of the items the base 2018 IRC lists as exempt from a building permit, but the county's separate Miscellaneous (zoning) Permit still applies. Barrier/enclosure requirements follow the adopted 2018 Residential Code for private pools.
Installing an above-ground pool without the required Miscellaneous Permit, or too close to a property line, is a code violation subject to stop-work and correction orders through Jeffco Building Safety.
