Above-ground pools deeper than 42 inches follow the same Lake County rules as in-ground pools: a 4-foot barrier, no placement in required street or interior side setbacks, and at least a 5-foot rear-yard setback from side and rear lot lines. A county building permit is required in unincorporated areas.
Lake County UDO 154-9-140 treats above-ground and in-ground pools alike. Subsection C prohibits pools and hot tubs in any required street or interior side setback area, and subsection D requires rear-yard pools to be set back at least 5 feet from side and rear lot lines. The 4-foot barrier of 154-9-140.B applies; an above-ground pool's own wall may count toward the barrier if it meets the height and gate standards. Cities set their own above-ground pool rules.
Placing an above-ground pool in a prohibited setback or without the required barrier is a zoning violation subject to correction orders and fines by the Plan Commission.
