Under the PA UCC and the adopted ISPSC, an above-ground pool with water depth exceeding 24 inches is treated identically to an in-ground pool for permit and barrier purposes. The pool wall itself can serve as the required 48-inch barrier when the wall meets that height. Ladders must be removable or capable of being secured against unauthorized use, and any deck or platform attached to the pool must be enclosed with code-compliant guarding. Electrical bonding to the National Electrical Code is required.
Installing without permit or compliant barrier draws stop-work orders and UCC fines up to $1,000 per day. Insurance coverage may be denied if barriers fail standards.
