Above-ground pools extending more than 12 inches above ground require a building permit and must meet setback requirements. Side setback is at least one-half the required district setback but not less than 3 feet. Full barrier requirements apply.
Metro Code and the 2018 IRC treat above-ground pools extending more than 12 inches above ground as structures requiring a building permit. Setback rules: located to the rear of the principal structure, a minimum side setback equal to one-half the zoning district's required setback applies, but never less than 3 feet; rear setback minimum is also 3 feet. Pools in front of the principal structure must meet full street setback requirements. Neither above-ground nor in-ground pools may be placed within easements or platted setbacks. Above-ground pools still require full barrier/fencing compliance (48-inch minimum) and pool alarm (if built 2011+). Pool decks attached to above-ground pools are treated as deck structures and may require additional permits.
Building without permit: stop-work order + retroactive permit. Non-compliant setback: may require relocation.
