NY Residential Code Appendix G (effective May 12, 2020) treats above-ground pools over 24 inches deep the same as in-ground pools. Permits are required from the town building department. Barriers must be at least 48 inches above grade on the outside; the pool wall itself can serve as the barrier if at least 48 inches tall. Ladders must be removable, lockable, or retractable when the pool is unattended. Pool alarms are required on doors leading to the pool or on the water surface per NY Executive Law 387(14). Local zoning sets setbacks, typically 10 ft from rear or side property lines. Electrical bonding and GFCI required per NEC.
Failure to permit or barrier: up to $1,000 per day. Pool alarm violations: $500 first offense, $1,000 subsequent (19 NYCRR 1228.2). Per-day violations can reach $5,000.
