Queens above-ground pools deeper than 24 inches need an NYC DOB filing and must meet Building Code 3109. A 48 inch pool wall with a removable or lockable ladder is accepted as a compliant barrier.
Above-ground pools are treated the same as in-ground pools under NYC Building Code 3109 when the water depth exceeds 24 inches, which includes most package pools sold in Queens. The filing must be prepared by a New York State licensed architect or professional engineer and submitted to the Department of Buildings, with a separate electrical permit for bonding and grounding under NEC Article 680. The most common permitted barrier design for an above-ground pool relies on the pool wall itself. If the wall is at least 48 inches high, continuous, and has no climbable footholds, it can serve as the required barrier, provided that access is limited to either a removable ladder that is taken down when the pool is unattended or a lockable ladder in the upright locked position. If an attached deck is installed, the deck edge becomes a human-scale opening and a secondary 48 inch barrier with a self-closing gate is required around the deck perimeter. Electrical equipment must be at least 5 feet from the pool edge, all metal components must be bonded together and to an equipotential grid, and GFCI-protected circuits are required for pumps and any outlets within 20 feet. Drainage of backwash water to a street or neighboring yard is not permitted and must be routed to the sanitary sewer.
