Section 305.1 of the NJ Swimming Pool and Spa Code exempts a spa or hot tub from the barrier requirements of Sections 305.2 through 305.7 when it is equipped with a lockable safety cover complying with ASTM F1346. Without such a cover, the same 48-inch barrier, gate, and opening rules that apply to pools apply to the hot tub. Electrical work for a spa or hot tub requires a construction permit under the NJ UCC (N.J.A.C. 5:23) from your municipal construction office. Public/commercial spas are separately regulated by the Burlington County Health Department under N.J.A.C. 8:26.
An uncovered, unenclosed spa or hot tub fails the barrier inspection; the construction official can require a compliant cover or barrier before approval.
