Under N.J.A.C. 5:23 (adopting the 2018 ISPSC), spas and hot tubs are covered structures. If a spa or hot tub is equipped with a lockable safety cover complying with ASTM F1346, it is exempt from the barrier requirements of code sections 305.2 through 305.7. Without such a cover, the spa must be enclosed by the same 48-inch self-latching barrier required for pools. A construction/electrical permit from your municipal Construction Code Official is generally required to install a hot tub. Morris County does not issue these permits or enforce spa safety; that is a municipal function.
A hot tub lacking either a compliant safety cover or a barrier fails inspection; municipalities may assess penalties for uncovered, unbarricaded spas.
