A permanently installed hot tub or spa in Prince George's County needs DPIE building and electrical permits. Under the International Residential Code the barrier is waived for a spa or hot tub with a safety cover complying with ASTM F1346; otherwise the 48-inch pool barrier standard applies.
The County regulates spas and hot tubs through the IRC pool appendix adopted by County Code Subtitle 4 and the Maryland Building Performance Standards. A permanent spa needs a DPIE building permit and an electrical permit covering GFCI protection, equipotential bonding and a disconnect within sight. The IRC provides that a spa or hot tub with a safety cover complying with ASTM F1346 is exempt from the perimeter barrier that applies to pools; remove the cover and the standard barrier rules apply. Cord-connected portable spas may have lighter permit triggers, but bonding and GFCI still apply. As a structure, a spa must meet zoning setbacks under Subtitle 27, and any privacy fence follows the County's general residential fence-height limits.
Operating a spa without the ASTM F1346 cover after relying on that exemption means it must meet the full IRC barrier. Installing spa wiring without the electrical permit, or running a spa without GFCI protection, is enforceable under Subtitle 4.
