Suffolk County, MA Swimming Pools & Spas: Pool Permits (2026)

All pool permits in Suffolk County follow uniform state standards under 780 CMR (State Building Code) and 105 CMR 435 (State Sanitary Code Chapter V — Swimming Pools). Boston Inspectional Services Department is the permit authority for Boston; Chelsea, Revere, and Winthrop have their own building departments. A building permit is required for all in-ground pools, spas, and permanent hot tubs, plus any above-ground pool exceeding 24 inches in water depth. Required plan review covers structural engineering, setbacks, drainage, electrical (GFCI per NEC Article 680), plumbing, and barrier compliance. Final inspection by the local building inspector is required before pool use. Boston's high density and small residential lots mean pools are rare in most neighborhoods — more common in West Roxbury, Hyde Park, Roslindale, Dorchester (larger lots), and Winthrop single-family zones. MGL c. 143 §§98-100 authorizes the local building inspector. Historic district pools in Back Bay or Beacon Hill also require Boston Landmarks Commission approval.
